На автомобиль упало дерево: суд объяснил, что делать
До разбирательства в Верховном суде довели дело с деревом, упавшим на автомобиль жителя Москвы. Происшествие случилось на земельном участке, который обслуживает ГБУ «Жилищник Рязанского района». Организация выяснила, что дерево было повалено в результате сильного порыва ветра (до 24 м/с), при этом раньше оно не было признано аварийным.
Автовладельца, которому пришлось потратить на восстановительный ремонт машины примерно 400 тыс. рублей, этот ответ не удовлетворил, так что он обратился к организации за независимой экспертизой. Как сообщает РАПСИ, специалисты выяснили, что лиственница имела корневую гниль, поэтому «она подлежала обязательному удалению из зеленного фонда города».
Отметим, суд первой инстанции встал на сторону автовладельца. Организация, обслуживающая земельный участок, на котором росло упавшее дерево, должна была исполнить свою обязанность по содержанию дворовых территорий (в том числе по контролю за состоянием зелёных насаждений, уборке деревьев, представляющих угрозу для жизни и здоровья граждан, а также для имущества).
Однако это мнение не поддержал Мосгорсуд. Он отменил предыдущее решение и отказал в удовлетворении иска. Тогда суд апелляционной инстанции сослался на тот факт, что дерево упало из-за неблагоприятных погодных условий. В Мосгорсуде решили, что по этой причине коммунальщики не должны оплачивать ремонт автомобиля, так как их вины нет в падении лиственницы.
В итоге собственник автомобиля направил жалобу в Верховный суд, после чего он разъяснил особенности подобных споров. Так, доказательством повреждения имущества истца в результате обстоятельств непреодолимой силы (об этом заявил Мосгорсуд) не может служить электронное предупреждение ГУ МЧС России по Москве о неблагоприятных погодных явлениях. Ведь это лишь прогноз и он не подтверждает их наступление, пояснил Верховный судья.
Также в ВС указали на то, что суд апелляционной инстанции не объяснил, почему он отверг заключение специалиста-дендролога об опасном состоянии лиственницы. Неясно и то, почему Мосгорсуд не принял довод о том, что деревья, растущие рядом с упавшей лиственницей, не были повреждены тем же сильным ветром.
Высшая инстанция пришла к выводу о том, что Мосгорсуд допустил существенные нарушения норм материального и процессуального права. В итоге ВС отменил апелляционное определение, а дело направил на новое рассмотрение.
В прошлом месяце стало известно о том, что Верховный суд РФ подготовил для нижестоящих судов инструкции по наказанию нарушителей ПДД. В последний раз ВС издавал подобный документ осенью 2006 года, так что сейчас он нуждается в обновлении.
